Terms of Use

These terms form a binding agreement between you and Aircraft Worldwide. Read section 7 (no warranty), section 8 (limitation of liability), section 9 (release) and section 12 (arbitration and class-action waiver) carefully — they limit what you can recover from us and how disputes are resolved.

Summary — the short version

Aircraft Worldwide is a venue where independent buyers and sellers find each other. We do not own, inspect, test, certify, install or ship any part or aircraft listed here, and we are not a party to any sale. Every transaction is between the buyer and the seller. Nothing sold through this site may be installed on an aircraft until a qualified, appropriately certificated person has independently determined it is aircraft-worldwide and eligible for that aircraft. This summary is for convenience only; the numbered clauses below control.

1 Agreement and eligibility

By accessing Aircraft Worldwide, creating an account, listing an item, or completing a purchase you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site.

You must be at least 18 and legally able to enter contracts. If you use Aircraft Worldwidefor an organization, you represent that you are authorized to bind it, and "you" means that organization.

2 What Aircraft Worldwide is — and is not

Aircraft Worldwide provides an online venue and related tools. We are not a parts distributor, dealer, broker, reseller, repair station, manufacturer, freight forwarder, escrow agent, insurer, or consignee, and we do not hold a certificate issued by the FAA, EASA or any other civil aviation authority.

We are not a party to, and have no involvement in, the contract formed between a buyer and a seller. No agency, partnership, joint venture, employment or fiduciary relationship is created between you and Aircraft Worldwide by these Terms or by your use of the site.

We do not take possession of, inspect, handle, store, test, disassemble, repair, recertify, or ship any item. Listings, photographs, descriptions, part numbers, serial numbers, condition codes, trace documents and certification records are created and supplied entirely by sellers.

3 No verification, no endorsement

We do not verify the accuracy of any listing, the authenticity of any 8130-3, EASA Form 1, COC, or other document, the existence or condition of any item, or the identity, solvency, honesty or qualifications of any user.

Badges, labels, ratings, sales counts and similar indicators — including any "Verified" marking — reflect only limited administrative checks on account information. They are not a statement that any part is aircraft-worldwide, genuine, traceable, serviceable, or eligible for installation, and must not be relied on as one.

4 Airworthiness — buyer's independent duty

Aviation parts can fail, and failures can cause damage, injury and death. You accept that risk knowingly.

No item obtained through Aircraft Worldwide may be installed on, or returned to service in, any aircraft unless and until an appropriately rated and certificated mechanic, repair station or other authorized person has independently inspected it, verified its traceability and eligibility for the specific aircraft, and determined it is aircraft-worldwide under applicable regulations. Determining eligibility, approval status and airworthiness is solely the buyer's responsibility and that of its certificated personnel.

You are responsible for identifying and reporting suspected unapproved parts (SUP) to the appropriate authority. Nothing on this site relieves any person of any obligation under 14 CFR, EASA regulations, or the law of any other jurisdiction.

5 Seller obligations and representations

For every item you list, you represent and warrant that:

  • you own it or are authorized to sell it, and it is free of liens and competing claims;
  • the description, part and serial numbers, condition code, cycles/hours, removal reason and certification status are accurate and not misleading;
  • all trace and certification documents are genuine, unaltered, and correspond to the actual item shipped;
  • it is not counterfeit, not a known or suspected unapproved part, not stolen, not scrapped or life-expired material represented as serviceable, and not subject to an uncomplied airworthiness directive you have failed to disclose;
  • the sale complies with all applicable export controls and sanctions, including ITAR and the EAR, and you will obtain any licence required;
  • you will ship what was described, within the time stated, and will deal with the buyer in good faith after the sale.

You are the seller of record. You are solely responsible for the item, for any warranty you choose to offer, for returns and refunds, for taxes arising from your sales, and for any claim brought by a buyer or any third party in connection with the item.

6 Payments, fees and settlement

Aircraft Worldwide charges the seller a commission of 10% of the sale price. Buyers pay no fee to Aircraft Worldwide.

Payments are processed by third-party payment providers under their own terms. Depending on the payment configuration in effect for a given transaction, funds may be routed directly to the seller, or may be received by Aircraft Worldwide and remitted to the seller net of commission. Where Aircraft Worldwidereceives funds, it does so solely as the seller's limited payment collection agent for that transaction; the buyer's payment obligation to the seller is discharged on receipt, and Aircraft Worldwidedoes not thereby become the seller, a party to the sale, an escrow agent, or a guarantor of either party's performance.

Aircraft Worldwidedoes not hold funds in escrow and does not guarantee, insure or underwrite any transaction. We do not adjudicate the merits of disputes between users. Chargebacks, refunds and payment reversals are governed by the payment provider's rules, and any amount charged back may be recovered from the seller.

7 No warranty — everything is provided as is

The site and all listings, documents, content and services are provided "as is" and "as available", without warranty of any kind.

To the fullest extent permitted by law, Aircraft Worldwide disclaims all warranties, express, implied and statutory, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, and any warranty arising from course of dealing or usage of trade.

Without limiting that, Aircraft Worldwide makes no warranty that any item is aircraft-worldwide, genuine, serviceable, traceable, correctly certified, eligible for any aircraft, fit for any purpose, or conforming to its description, and no warranty that the site will be uninterrupted, secure or error-free.

8 Limitation of liability

To the fullest extent permitted by law, Aircraft Worldwide and its owners, officers, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, aircraft use or availability, downtime, AOG costs, ferry or recovery costs, substitute procurement costs, goodwill, or data, arising out of or relating to the site or any transaction, whether based in contract, tort (including negligence), strict liability, product liability, or any other theory, and whether or not Aircraft Worldwide was advised of the possibility of such damages.

Aircraft Worldwide's total aggregate liability to you for all claims arising out of or relating to the site or any transaction will not exceed the greater of (a) the total commission Aircraft Worldwide actually received on the specific transaction giving rise to the claim, or (b) one hundred United States dollars (US$100).

These limitations apply even if a limited remedy fails of its essential purpose, and are a fundamental basis of the bargain between you and Aircraft Worldwide. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you; in that case our liability is limited to the greatest extent permitted by law.

9 Disputes between users — release

Aircraft Worldwide is not responsible for, and has no duty to intervene in, the conduct of any user. This includes a seller who fails to ship, ships the wrong or a defective item, supplies false or altered paperwork, misrepresents condition or traceability, refuses a refund, becomes unreachable, or disappears after being paid; and a buyer who fails to pay, files a fraudulent chargeback, or damages or misuses an item.

Your sole recourse for any such matter is against the other user, together with any remedy available from your payment provider or card issuer.

You release Aircraft Worldwide and its owners, officers, employees, contractors and agents from any and all claims, demands, damages and liabilities of every kind, known and unknown, arising out of or in any way connected with any dispute or dealing between you and any other user, or with any item listed, bought or sold through the site. If you are a California resident, you waive California Civil Code §1542, which reads: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any comparable statute or rule in any other jurisdiction.

10 Indemnification

You will defend, indemnify and hold harmless Aircraft Worldwideand its owners, officers, employees, contractors and agents from and against any claim, demand, investigation, loss, liability, damage, penalty, cost and expense (including reasonable legal fees and expert costs) arising out of or relating to: your use of the site; any item you list, sell, buy, ship, install or return to service; any content you submit; your breach of these Terms or of any representation you make; your violation of any law or regulation, including export controls, sanctions and airworthiness requirements; or your infringement of any third party's rights.

This obligation survives termination of your account and expressly includes claims for property damage, personal injury and death alleged to arise from an item transacted through the site.

11 Prohibited conduct

You may not list or sell counterfeit, stolen, scrapped, life-expired or suspected unapproved parts; falsify, alter or fabricate certification or trace documents; misstate condition, time or cycles; transact in violation of ITAR, the EAR or applicable sanctions; circumvent the site to avoid commission after being introduced through it; scrape, overload, probe or interfere with the site; or impersonate any person or misrepresent your affiliation.

We may remove any listing, suspend or terminate any account, and report conduct to regulators or law enforcement, at our discretion and without notice or liability.

12 Governing law, arbitration and class-action waiver

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws rules, and excluding the UN Convention on Contracts for the International Sale of Goods.

Any dispute arising out of or relating to these Terms or the site that is not resolved informally within 30 days of written notice will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Florida, in English, before one arbitrator. Judgment on the award may be entered in any court of competent jurisdiction. Either party may bring an individual claim in small claims court instead.

Claims may be brought only in your individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. You and Aircraft Worldwide each waive any right to a jury trial. If the class-action waiver is held unenforceable as to a particular claim, that claim is severed and proceeds in court, and the remainder stays in arbitration.

13 Content you submit

You keep ownership of the listings, photographs and documents you upload, and grant Aircraft Worldwide a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize and display them for the purpose of operating and promoting the marketplace. You represent that you hold the rights necessary to grant that licence.

14 Suspension, termination and changes

You may close your account at any time. We may suspend or terminate access at our discretion, including for suspected fraud, safety risk, or breach of these Terms. Sections 2 through 12, 15 and 16 survive termination.

We may change these Terms. Material changes take effect when posted with an updated effective date, and your continued use afterwards is acceptance. Changes do not apply retroactively to a dispute of which we had notice before the change.

15 Force majeure, severability, assignment

Neither party is liable for failure to perform due to causes beyond its reasonable control. If any provision is held unenforceable, it is limited or severed to the minimum extent necessary and the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.

16 Entire agreement, language, contact

These Terms, together with the Privacy Policy, are the entire agreement between you and Aircraft Worldwide regarding the site, and supersede all prior understandings. Translations are provided for convenience only; the English version controls in the event of any conflict.
